CA Noise Bill SB435

SB435 has been before the California legislature for some time and various motorcycle groups have been involved in its discussion, most opposed.

If this bill is signed into law by the governor you can expect it to be tried in other parts of the country.

Will this bill affect you or someone you know?

If you live in California and or know people who do, have them write, e-mail or phone the Governor’s office and ask him not to sign this into law.

If you do Not Live in CA contact the governor and let him know you have seen his television ads about visiting California and though you are considering it you will not if you can not ride your motorcycle there because of this law.

The fact that the Governor does own motorcycles does not mean he will not sign this bill into law. Remember it will not affect him or his motorcycles as no cop that wants to keep his job will ticket him.

SACRAMENTO -- California lawmakers want to put a plug in the earsplitting roar from modified motorcycles.

The state Senate today voted 21-16 to pass SB435. The bill makes it a crime to operate a motorcycle manufactured after Jan. 1, 2013, that fails to meet federal noise-emission control standards.

Motorcyclists whose vehicles lack the proper U.S. Environmental Protection Agency label would be subject to a fine.

Supporters say many motorcycle owners modify their bikes to make them much louder, which in turn creates a public nuisance. Those modifications also allow the motorcycle to produce more harmful emissions.

Opponents of the bill say many aftermarket exhaust systems meet emission standards but aren't labeled, meaning law-abiding riders could be unfairly ticketed.

The bill now goes to Gov. Arnold Schwarzenegger, who owns multiple motorcycles.

    There is much more going on then just a noise bill (SB435). This bill first started off as a smog bill based on lies (false comments regarding smog levels generated by motorcycles) from the American Lung Association. The Lung Association stated motorcycles smog 10 times more than cars, while actual smog tests, some from CARB, show less than 1% (.06%). These reports are public records. Many are calling for a boycott of the American Lung Association. But SB435 is a redundant law. There have been EPA Stamp laws on the books for 30 years. In CA there are 7 vehicle code laws that deal with noise and tampering with mufflers. SB435 is a secondary law, the officer must stop you for something else before checking your pipes. So why all of the lies and deals from Senator Pavely’s office? Why all of the back door negotiations with CARB, Noise-Off, a Councilman from Boston and of course the EPA. Why the falsification of documents?

    In peeling back the onion the stench of what is really going becomes apparent. Similar laws are being introduced across the country. The EPA has investigated 9 after market motorcycle exhaust manufacturers. Why 9 and not 10 or more…i will let you research that one…more stench from peeling back the onion.

    The EPA office of Air and Radiation, headed by Ken Feith and soon to be run by Catrice Jefferson, sent a letter to one of the after market shops they raided,( they threatened the owners with a $10,000 fine per pipe if they did not comply with the EPA)

    I would like to quote a portion of that letter; QUOTE “Our meeting with was our first in a planned series of meetings with manufacturers of bikes and after market noise control components in order to determine the state of current technology and problems that may exist in complying with the existing regulations and possible U.S. harmonization with the forthcoming global regulations from the United Nations Economic Commission for Europe, Working Party on vehicle safety and environmental regulations (WP-29)” End Quote.

    Our Federal government wants to put American Bikers under United Nation rules, European Rules.

    Another person involved in these investigations of after market exhaust systems was Bill Battye, managing partner for a company called EC/R. They are a private company working on behalf of the EPA.
